This case arises out of tragic circumstances. Just four days after he was paroled from state prison, Gilton Pitre raped and killed Alyssa Gomez. Gomez's sister, plaintiff and real party in interest Elaina Novoa, contends that Pitre was a "sexually violent predator" within the meaning of the Sexually Violent Predators Act (SVPA) (Welf. & Inst.
