Plaintiff Anna Peng sued her employer, defendant First Republic Bank, for employment discrimination, intentional infliction of emotional distress, and wrongful termination. The trial court denied defendant's motion to compel arbitration, finding the parties' arbitration agreement to be fatally unconscionable.
