OPINION

KING, Circuit Judge:

In 1975, petitioner Larry Waddell was convicted of first-degree murder in the Superior Court of Mecklenburg County, North Carolina, and sentenced to be executed. His death sentence was vacated by the Supreme Court of the United States in 1976, and later that year Waddell was resentenced to life imprisonment. In 2010, Waddell sought habeas corpus relief in the Western District of North Carolina pursuant to 28 U.S.C. § 2254...
