On October 2, 2009, WCI Communities, Inc. (the "Plaintiff')2 filed an adversary complaint (the "Adversary Complaint") against Joseph and Fabiola Espinal individually, as parents and natural guardians of Emily and Camila Espinal, and as representatives of an alleged class of similarly situated individuals (the "Espinals").3
