HALL, Judge.

¶ 1 Defendant, Vernon Tillmon, appeals from his convictions for one count of transportation of marijuana for sale, in an amount greater than two pounds, one count of possession of drug paraphernalia, and the sentences imposed. We conclude that the trial court erred when it denied defendant's motion to dismiss filed on the twentieth day before trial as untimely pursuant to Arizona Rule of Criminal Procedure 16.1(b).
