In 2005, appellant Kevin D. Tate was found guilty in the Garland County Circuit Court of the felony offense of murder in the first degree in the shooting death of his girlfriend. He was sentenced to a term of 480 months' imprisonment. The jury declared that the sentence should be enhanced pursuant to Arkansas Code Annotated section 16-90-120 (1987) by an additional term of 180 months' imprisonment for use of a firearm in the commission of the felony.
