Appellant Warren School District (the District) employed appellee, Colonel Robert Avery, (Avery) as an ROTC instructor from July 1, 2003, through January 28, 2010. S.C. was a sixteen-year-old female student enrolled in the ROTC program. The District's school board terminated Avery's teaching contract after Avery was charged with first-degree sexual assault of S.C.
