Appellant Bernard Marks was convicted in the Jefferson County Circuit Court of capital murder and was sentenced to life imprisonment without parole. This court affirmed. Marks v. State, 375 Ark. 265, 289 S.W.3d 923 (2008). Appellant then filed a petition and an amended petition for postconviction relief pursuant to Arkansas Rule of Criminal Procedure 37.1 (2011).
