In August 2008, appellant Joe Newman, a level-four sex offender, was in the seventeenth month of a twenty-four-month period of probation for an underlying offense of failure to register as a sex offender. At that time the probation/parole office received a report that appellant was working at a daycare center. In October 2008, the State filed a petition to revoke his probation, alleging that he had violated the terms and conditions of his probation...
