In 2008, appellant John Cummings entered a plea of nolo contendere to a charge of murder in the first degree. A sentence of 336 months' imprisonment without parole was imposed. Subsequently, petitioner timely filed in the trial court a verified pro se petition for postconviction relief pursuant to Arkansas Rule of Criminal Procedure 37.1 (2009).
