James Hendrix appeals from an order of the Pope County Circuit Court granting appellee David Stobaugh's motion for summary judgment and dismissing Mr. Hendrix's complaint for personal injuries that he sustained at Stoby's, Mr. Stobaugh's restaurant in Russellville. Because Mr. Hendrix failed to present evidence that a genuine issue of material fact existed regarding Stoby's alleged negligence, we affirm the circuit court's order.
