Darrius Javon Frye was convicted of first-degree rape, see § 13A-6-61, Ala. Code 1975, and first-degree sodomy, see, § 13A-6-63, Ala.Code 1975. The trial court sentenced Frye to life imprisonment for each conviction pursuant to the Habitual Felony Offender Act, see § 13A-5-9, Ala.Code 1975.
