PER CURIAM.

Chong Fan appeals from a judgment of the Madison Circuit Court ("the trial court") dismissing his complaint against Qualitest Pharmaceuticals. We affirm in part and reverse in part.

Facts and Procedural History

On September 22, 2010, Fan filed in the trial court a complaint against Qualitest. The complaint stated:
