Riverstone Development Co., Inc. ("Riverstone"), and Southern Heritage, LLC ("Heritage"), appeal from a judgment dismissing, pursuant to Rule 41(a)(1), Ala. R. Civ. P., an action in which they had intervened as defendants. We reverse and remand.
