The State of Alabama appeals the trial court's pretrial dismissal of the charges against Steven Tim Harwell. The following facts are undisputed. Harwell was indicted by a Montgomery County grand jury for theft of property in the second degree, a violation of § 13A-8-4, Ala.Code 1975, and for burglary in the third degree, a violation of § 13A-7-7, Ala.Code 1975. A trial on those charges was set for January 10, 2011, but the courthouse was closed...
