Count I of the indictment charged Bailey with murder during the course of a first-degree burglary, committed while he or his codefendant, Harold Wayne Bailey, was armed with a gun, a violation of § 13A-5-40(a)(4), Ala.Code 1975; Count II charged Bailey with murder during the course of a second-degree burglary...
