Aletha Brown Thomas ("the wife") sued her brother-in-law Brian Thomas ("the brother") in the Montgomery Circuit Court seeking to recover the proceeds of a term life-insurance policy owned by John T. Thomas, Aletha's husband ("the husband"). After a bench trial, the trial court entered a judgment in favor of the brother.
