David Lamar Dudley, Jr., was arrested and charged with unlawful possession of marijuana in the first degree, a violation of § 13A-12-213, Ala.Code 1975. Dudley filed a pretrial motion to suppress the evidence seized from him by law-enforcement officials namely, a brown paper bag filled with smaller plastic bags containing a green, leafy substance later determined to be marijuana.
