Marsha Colby was convicted of capital murder for the killing of her newborn baby, see § 13A-5-40(a)(15), Ala.Code 1975. The trial court sentenced Colby to life imprisonment without the possibility of parole, and the Court of Criminal Appeals affirmed the trial court's judgment, in an unpublished memorandum. Colby v.
