The State of Alabama filed this petition for a writ of mandamus directing Judge Robert Smith to set aside his rulings related to discovery in George Martin's Rule 32, Ala.R.Crim.P., proceedings. In May 2000, Martin was convicted of murdering his wife, Hammoleketh Martin, for pecuniary gain, an offense defined as capital by § 13A-5-40(7), Ala.Code 1975.
