The appellant, James Randall Kelly, was convicted of first-degree theft of property, a violation of § 13A-8-3(a), Ala.Code 1975.1 The trial court sentenced him to serve a term of seven years in prison, but suspended his sentence and placed him on probation for four years. The appellant did not file any post-judgment motions. This appeal followed.
