Lewis Nels Olson attacked his girlfriend and broke her jaw. Based on this incident, Olson was charged with first- and second-degree assault, and the jury found him guilty of both charges. Olson moved for a judgement of acquittal on both charges. The superior court granted Olson's motion with respect to the first-degree assault charge, because the court concluded that Olson had not used...
