On 14 January 2013, David Keith Price (defendant) was indicted by superseding indictment for possession of a firearm by a felon under N.C. Gen.Stat. § 14-415.1. Defendant filed three pre-trial motions. First, he filed a motion to dismiss in which he argued, inter alia, that the North Carolina Felony Firearms Act was unconstitutional on its face and as applied to him.
