Factual and Procedural Background

Because Ms. Pamla G. Laws was obese and had suffered from severe sleep apnea, she had gastric bypass surgery ("bariatric surgery") to help her lose weight. Dr. Thomas Helling performed the surgery, and afterwards Ms. Laws was taken to a post-anesthesia recovery room. An order on Ms. Laws's chart stated, "Elect not to extubate
