KAFKER, J.
Observed obviously intoxicated and urinating in public immediately after driving onto a pier in the Charlestown section of Boston, the defendant, Gregory Belliveau, was convicted of operating a motor vehicle while under the influence of alcohol (OUI), fifth offense, in violation of G. L. c. 90, § 24(1)(a)(1), as amended through St. 2003, c. 28, §§ 1, 2.
