STATE v. TRAVIS

No. 2012-KA-0836.

109 So.3d 1036 (2013)

STATE of Louisiana v. Ramon TRAVIS.

Court of Appeal of Louisiana, Fourth Circuit.

February 27, 2013.

Attorney(s) appearing for the Case

Leon A. Cannizzaro, Jr. , District Attorney, Scott G. Vincent , Assistant District Attorney, New Orleans, LA, for Appellant/State of Louisiana.

Christopher A. Aberle , Louisiana Appellate Project, Mandeville, LA, for Defendant/Appellee, Ramon Travis.

(Court composed of Judge DENNIS R. BAGNERIS, SR., Judge TERRI F. LOVE, Judge MADELEINE M. LANDRIEU).

TERRI F. LOVE, Judge.

This appeal arises from the State seeking review of the trial court's granting of Ramon Travis' motion to quash based on the expiration of the two-year prescriptive period for commencement of trial. For the reasons that follow, we find that the trial court did not abuse its discretion in granting the motion to quash, as the two-year prescriptive period expired and affirm.
