Gulf Coast Bank & Trust Company loaned Elizabeth and Ferdinand D'Orville money. The loan was secured by a mortgage on the D'Orvilles' home and by a guaranty signed by Norbert Simmons. The loan became delinquent, and ultimately the D'Orvilles' debt to the bank was discharged in bankruptcy. Following the foreclosure and sheriff's sale of the home, the bank sought to collect the resulting deficiency from Mr. Simmons. The trial court granted...
