On 31 March 2009, the defendant, Michael Williams ("Williams") was charged in count one of a bill of information with possession with intent to distribute heroin and in count two with being a felon in possession of a firearm. He pled not guilty at arraignment.

Williams filed motions to suppress the evidence and statement. Hearings on the motions were conducted on 16 July 2009 and 13 January 2010. The trial court granted the motion...
