On 22 May 2008, the state charged the defendant, Allen Berry ("Berry"), by bill of information with one count of violating La. R.S. 14:95 E, possession of a firearm while in possession of a controlled dangerous substance, and one count of violating La. R.S. 40:966 C(1), possession of heroin.1 On 30 June 2008, Berry appeared before the trial court for arraignment and entered a plea of not guilty to the charges...
