The defendant, Gary Juengain, appeals his conviction for possession of cocaine and seeks a remand to the trial court for consideration of his motion for a new trial. After review of the record in light of the arguments of the parties and applicable law, we conditionally affirm the defendant's conviction and remand the matter to the trial court for consideration of the defendant's timely-filed motion for a new trial.
