This case arises from a tram-car collision at the State Highway 163 grade crossing in Jonesboro, Arkansas, on March 2, 1996. A train operated by Defendant Union Pacific Railroad (Union Pacific) collided with a car operated by Charles Sipes. The impact resulted in the death of Faith Sipes, a passenger in the Sipes vehicle.
