Petitioner Ramon Acosta ("Acosta") brought this action pursuant to 28 U.S.C. § 2255 seeking to vacate, set aside or correct his sentence. Acosta was found guilty after a jury-trial of conspiracy to commit robberies and committing armed robberies in violation of the Hobbs Act. 18 U.S.C. § 1951.
