On December 29, 2010, the Court entered an Opinion and Order (Docket No. 176) granting at that time Plaintiffs' unopposed1 request to proceed under a culpa in vigilando theory as neither this Court nor the First Circuit Court of Appeals had previously addressed the applicability of such a theory of liability to the instant case.2
