This matter comes before the court on the defendant's motion for summary judgment of noninfringement and invalidity of the 5,355,964 Patent (the "'964 Patent") and plaintiff's cross-motion for summary judgment of infringement. For the reasons set forth below, the court GRANTS the defendant's motion, in part, and DENIES
