The defendant, Everton Gardner, moves to suppress statements made by the defendant to Detective Robert Davis on September 28, 2003, at Hartford Hospital. The defendant claims that the waiver of his Miranda1 rights was not voluntary due to pain medication that he was given prior to speaking with Davis.
