Note from the reporter of decisions: On August 19, 2013, the Court of Criminal Appeals issued an order denying Donald Spruill's petition for a writ of mandamus requesting that court to order the Houston Circuit Court to set aside its order scheduling Spruill's case for a bench trial after finding that Spruill has waived his right to a jury trial by signing a pretrial-diversion agreement. Judge Joiner dissented and issued an opinion.
