I agree with the Court's decision to grant Applicant, John Dewayne Westerman, habeas corpus relief. I write separately to address the dissent's argument that the doctrine of laches should bar relief in this case. Laches, which is concerned with prejudice to the opposing party due to delay, should not bar relief in this case.
