PER CURIAM

Midwest Special Surgery, PC appeals from the grant of summary judgment in favor of Phillip M. Bueschel and Turner Construction Company on the basis that the Texas Workers' Compensation Act applies to the case and dictates the rights and remedies of the parties. We affirm.
