Our original opinion in this case was based largely on the Texas Supreme Court's decision in Porter v. Vick, 888 S.W.2d 789 (Tex.1994) (per curiam). Thereafter, however, the supreme court overruled Porter. In re Baylor Med. Ctr. at Garland, No. 06-0491, 2008 WL 3991132 (Tex. Aug.29, 2008).
