No. 06-08-00085-CR.

279 S.W.3d 434 (2009)

Patrick Wayne PUCKETT, Appellant, v. The STATE of Texas, Appellee.

Court of Appeals of Texas, Texarkana.

Decided February 13, 2009.

Attorney(s) appearing for the Case

Tim Cone, Gilmer, for appellant.

Zan Colson Brown, Asst. Dist. Atty., Longview, for appellee.

Before MORRISS, C.J., CARTER and MOSELEY, JJ.

OPINION

Opinion by Chief Justice MORRISS.

Almost five years1 after the bar room brawl that resulted in serious personal injury to Timothy Driscoll and aggravated assault charges against Patrick Wayne Puckett, Puckett was tried, convicted, and sentenced to five years' confinement. Because that delay denied Puckett his constitutional right to a speedy trial, we reverse the judgment and render a judgment of acquittal.
