This matter comes before the Court on the defendant's motion to dismiss the plaintiff's pro se complaint or, in the alternative, for summary judgment. Because the complaint, even when liberally construed, does not state a claim upon which relief may be granted, the defendant's motion will be granted and the complaint will be dismissed.
