MEMORANDUM OPINION

This declaratory judgment action comes before the court on the Defendant's Motion to Dismiss under the Wilton/Brillhart Doctrine1 (doc. 7). The parties have fully briefed the motion. For the reasons stated below, the court finds the motion is due to be granted, and this action dismissed without prejudice.
