Before the Court is Defendant RE/MAX International, Inc.'s Motion for (i) Dismissal of RE/MAX's Counterclaim with Prejudice under Rule 41(c), and (ii) Dismissal of Counts I and II of Amerimax's Complaint for Lack of Subject Matter Jurisdiction under Rule 12(b)(1). For the following reasons, the Court grants Defendant's Motion without any award of attorneys' fees
