By Order dated January 28, 2009, the Court granted the motion brought by Don Moody, et al. (the "Moody parties") against Kyle Morris, et al. (the "Morris parties") to dismiss with prejudice the Amended Complaint in 08 Civ. 7683 and, as a result, also dismissed as moot the Declaratory Judgment action brought by the Moody parties in 08 Civ. 7604. This Memorandum Order sets forth the reasons for those determinations...
