Opinion by Justice CARTER.

This is an appeal from a forfeiture proceeding brought under Chapter 59 of the Texas Code of Criminal Procedure in which the trial court ordered the forfeiture of $24,156.00 seized from Donald Rhyne when his vehicle was searched incident to his April 2002 arrest. Rhyne complains that the trial court erred as a matter of law by granting summary judgment in favor of the State....
