On June 16, 2004, defendant was found to be in possession of a piece of sharpened metal while he was incarcerated at the Southport Correctional Facility in Chemung County. As a result of this incident, he was charged in an indictment with promoting prison contraband in the first degree and was found guilty of the charge at a jury trial.
