In May 2002, John and Carol Wagner attempted to refinance the mortgage on their Kansas City, Missouri, home.1 Mortgage Information Services, Inc. ("MIS") was the escrow agent in this refinancing. During the transaction conflicting information was provided as to the precise amount the Wagners owed to their previous lender.
