Ordered that the judgment is reversed insofar as appealed from, on the law, with costs, the complaint is reinstated against the defendant Jamaica Hospital Medical Center, the motion for summary judgment dismissing the complaint insofar as asserted against that defendant is denied, and the order dated August 22, 2006, is modified accordingly.
