In this action for divorce and ancillary relief, the plaintiff husband moves, pursuant to CPLR 3212, for summary judgment granting him a conversion divorce. The defendant wife opposes the motion on the basis that a judgment of divorce cannot enter because their separation agreement does not comport with Domestic Relations Law § 177.
