Ordered that the order dated July 11, 2006 is modified, on the law, by deleting the provision thereof granting that branch of the motion of the defendants in action No. 1 which was to dismiss the cause of action to recover damages for breach of contract insofar as asserted against the defendant Hudson Service Management, Inc., and substituting therefor a provision denying that branch of the motion; as so modified, the order dated July 11, 2006 is affirmed insofar as appealed...
